I suspect that OP may have mis-understood what the police told her.The police would NOT be able to tell you that you are legally married in California. They have NO WAY of knowing that.
CA is a community property state. So if they are legally married, then she would be entitled to 1/2 of any community property. If the car was purchased while they were married, it should be community property.
OP's problem is that she has to divorce and go to court to assert that right - and it's not going to help her any time soon.
Now, she COULD request temporary use of the car while the divorce is pending, but that should have been done right at the start. Trying to do it now will probably take more time than she has until the baby is born. And that doesn't even get into ex's annulment which makes the marriage itself questionable.
