Exactly one week ago I was in the passenger seat of a car that got pulled over. The driver is 21, I am 21, and the guy in the backseat is 19. The cop discovered we had been drinking. All 3 of us blew under the legal limit but we all received open containers. The kid who was 19 did not rat us out and rather took an MIP charge, claiming the alcohol he had was his. It was his 2nd charge so he has to go to court tomorrow for it. He informed me he is going to plead not guilty to it by telling the court the beer was ours and we gave it to him. What are the chances he can overturn the charge and we can be charged with supplying to a minor?

he straight up told me he's gonna tell the judge we bought it for him but there's no way he has any proof. My guess is that the MIP charge would be separate of supplying to a minor though, am I right? Regardless of whether we bought it for him or not, he was still a minor in possession, correct? Sooo even if the charge is overturned, my hope is that the supplying to a minor charge wouldn't even be considered.....?

And please stop helping 19 year olds to break the law.

BTW, I'm not sure what the friend hopes to gain by it. He could get an MIP conviction whether he bought the beer or OP did.
