I am not a lawyer or associated with the legal profession in any way. I am a retired military officer. As long as you are married to a service member you are entitled to free legal advice at any military base legal assistance office. It need not be Air Force. A military legal assistance officer can advise you of all current legal policies concerning family members including all your rights and obligations. I have made use of that benefit for more than 50 years. I advise you to do so as soon as possible.

It appears that the military will honor (within limits) whatever agreements are reached in a civil divorce or legal separation agreement. So if the legal separation documents state that the wife will not pay support to the husband, then the military will follow that.

I'll tell you straight out -- the military does not like to become involved in divorce/support matters. Divorce and support is a civil matter, and the military feels that such should be resolved by family courts. So -- first of all -- the military services consider "adequate support" to be whatever a divorce court or family court orders. If there is a court order or a written, legal separation agreement, stating a certain amount of support, that's what the military will go by.

In summary, I would not count on receiving BAH. You were married only a short time, so it is unlikely that your stbx would be required to support you after receiving legal separation. And without a court order for support, the military is not likely to do anything.
You'll need to be able to support yourself-which is presumably what you were doing before you got married 2 years ago.
