Hello,

My friend is going through a divorce and currently lives in CA. He offered a large lump sum to his ex in exchange for her to keep the children forever. This was their agreement. Now she is not willing to sign because she wants him to have spilt custody. He does not want this because he is moving to Fla. He is afraid that the court will mandate him to stay in CA and force him to take custody. He has no car or home. Could the CA court do this?

Have both parents put the children up for adoption since neither one of them wants them. Your friend sounds like a shameful parent -- willing to sell his children for a lump sum. Which by the way, the court will NOT allow. Mom at least wants dad to be included in the children's lives but that is a pathetic reason to want to force dad to have split custody. Mom should take the large lump sum and THEN sue dad for child support. Dad can go on his merry way and be the pathetic individual he is.

So, how is he going to give her a lump sum of money if he has no car or no home? Who are you in this situation?

The new girlfriend who doesn't want to deal with dad's baggage. Hence he has a new home if he lives with HER. Or it could be the new boyfriend of dad. Don't want to make gender-specific assumptions.
