What is the name of your state (only U.S. law)? Georgia.
a friend of mine signed a divorce aggreement draft upon her former attorney's advice back in october. she and her husband ended up sharing the custody of their 2 year old child. but the agreement limits her freedom to travel with the child outside US. in detail it requires attorney's notice and monetary deposit from her prior to action taking place. she has a big language barrier and her former attorney misled her. the judge hasn't signed the agreement and final decree hasn't come out yet. the father doesn't know how to take care of her. she has had an amount of complaint towards the time the child has spent with him during visitation so far. the child's father recently just filed a motion thru attorney to put harshier terms on child's mobility when the mother needs to travel with internationally, which extends the ban up to 18 old. she has very limited income. now she faces upcoming court hearing since the motion is granted. what's the chance if she reprensts herself in court? is she able to file response to the motion or just motion to request the full custody of the child due to the fact that the father is not reliable in rearing the child? she's has very limited income to hire a lawyer. how can she get free or low cost legal representation?

This is not your legal issue. Why don't you pay for her attorney since you are so interested in helping her?

If she has a language barrier, then you cannot expect that she would be able to properly represent herself. So she will need an attorney, hence my response.:cool:

I suspect that, with such a language barrier, her former attorney didn't mislead her...she simply didn't understand. Why wouldn't she find an attorney she could understand?

If she can't understand the language, she has no business dallying in the legal world in a language she can't understand.

We only care to deal with the principals involved. That means the wife or the husband. No one else.

Please don't misunderstand but you also have a language barrier - in writing at least. Your friend needs an attorney. If they do not have the money to afford an attorney, they can attempt to gain assistance from Legal Aid.

On the other hand, since she cannot afford an attorney, she certainly cannot afford a vacation outside the US either. So she really needs to decide exactly how important it is to her to visit outside the US.

If Grandma and Granddad live oversees, she should explore using webcams for her child to interact with them as an affordable alternative.

Frankly, if it were me? I would do everything in my power to make sure my child did NOT leave the US at all or make it as incredibly difficult as possible for my ex to take them out of the US if my ex had family out of the country.

Why would anyone work for "free or low cost"???

I am an attorney and why should I represent someone from free?
Do YOU work for free or is it only attorneys that should do something for nothing?

Quite frankly, why should she have carte blanche to travel internationally with the "joint" child? Oh yeah. She shouldn't. The child's father has a right to prevent his child from being removed from this country.

Dad wants to make sure that if mom leaves the country with the child, she will return with him at the agreed-upon time. That's what the deposit is for, and it's COMPLETELY understandable for dad to want that put into the agreement. If it was your child, wouldn't you want the same thing?

You got that right, I didn't understand anything my ex's attorney or the judge said. But I did pick up on my attorney speaking out of both sides of his mouth.

Its a good think that I didn't think that way. If I had, my daughter would have missed out on a lot a great experiences visiting her grandparents in Italy. Was it scary at first? Absolutely. However, she had the right to know and understand that half of her culture.

Your circumstances, I'd guess, were different than what this poster is posting. His friend who does not have money for an attorney is concerned with their ability to take the child from the country. That does not instill confidence that the child and Mom will be coming back to the states. The request to notify an attorney prior to any departure is not an unreasonable request. The deposit being given to an attorney as a means to ensure the child returns is simply another deterrent to Mom staying in her country. If an ex said, no problem and complied with it, I'd be more comfortable with the child leaving. Instead, they want to fight it. That creates more concern, not less.

There needs to be some trust between the parents before either of them would be comfortable with letting the child leave the country with the other. There must be SOME reason that dad would fear mom not bringing the child back.
