Fraud?

I reside in Wisconsin - I have an interesting situations I desperately need help with. I will attempt to make it as short and to the point as possible. Knowing my role in the situation I know I can only be a reference or guide to the person I wish to help as well.

In June of 10' my Fiance used her life savings from a joint checking account between her and the father of her child (unmarried). The majority if not all the money used for the house was hers. She was also led to believe that the house would be hers once her financial situation was addressed and her credit score was higher. She was told there was no way she was allowed on the deed because of her credit rating.

Her credit was not high enough to get a loan in her name, so the father of her child took out the loan, and his parents co-signed. Him, his father, and his mother were on the deed.

October 2010, he was inebriated and caused an accident with her child, his father quickly did a change of deed so his father and his mother were the only two on the deed to avoid financial repercussions on his sons behalf. His still has the mortage in his name.

My fiance has paid her half of the mortage until october 2010, his parents made a few payments. The majority of the Mortage/Insurance/Taxes has been paid by my fiance.

We have had difficulties paying the full amount for their mortage, and threatened to be removed from the house by the father of her child in Nov 2011. We signed a lease with his father October of 2011, back dated to July of 2011. When signing the lease he made it very clear that him and his wife were owners of the house.

When I asked about him reimbursing her for the down payment, loan/tax/insurance payments and money put into the house for repairs and upgrades he refused.

Since october of 2010, the father of her child has had tens of thousands of dollars worth of star wars toys shipped to the house, and has refused to stop after asking him to for over a year. I marked the last one return to sender, and when notifying him of this over the phone he made the comment "get a f****ing job so I don't have to pay for your subsidized housing." And we have made the agreed rent payment.

We do not want to purchase the house any longer because of the emotional and fianancial over head. There are many problems with the house that are health/fire/saftey hazards, such as black mold, poor electric and other issues when something goes awry and i attempt to fix, and the issue is related back to the craftsmanship of the previous owners remodeling.

I don't know what to do, or where to turn for assistance. Our anxiety and stress levels are absolutely off the charts. There are many other compounding issues that bring on great emotional distress that impede our daily personal lives. I used to go with her during the parental transition of the child, but turned sour very quickly after the father of the child was not able to show up for the exchange, and his mother made a crass comment about us not being able to pay our rent. I am going to rejoin her with the exchanges, because of her ex's inability to control his verbal outbursts, and fear that he would get physical if not bring a weapon during these exchanges.

We are currently looking for a new residence to reside with in our budget, and press other legal matters that needed to be addressed earlier.

I really need help, and direction to the right forms, legal education, preparation would be absolutely appreciated. I feel that there is a fraud going on, but do not know enough regarding the law in these matters to help my Fiance in any way.

What to do about what? You appear to have no ownership of the house and no responsibility to pay. The money you and your fiancé paid isn't going to be recoverable.

It just seems crooked to me to make some one else pay your mortgage and down payment while leading them to believe that they will own it.

That'd make this situation all too easy... Because we are on a lease, and with all the money paid thus far, could we use the previously paid amounts before the lease against upcoming rent?
No, the money paid before was rent for the period before.
