What is the name of your state (only U.S. law)? South Carolina We had a piece of land for sale and the people wanted to make payment on it until it was paid off. They put $1300.00 down and we signed a contract and had it notarized at a local bank. Than we found out the land was in foreclosure we immediately told the people that the land was in foreclosure and if they want it still they could get it out of foreclosure and just pay off the remaining balance that was still left to pay on the loan. They agreed and i set up a repayment plane with the bank to get it out of foreclosure and they still wanted it , they than put a thousand dollars on the loan and only had to make 4 payments of 365.00 dollars payment and it would be out of foreclosure. they also took the property tax bill on the land and said they would pay that to. Well come to find out that was the only payment they made , and never told us they stopped paying on the loan. they say the made one of the 365 dollar payments but the bank says the didn't and they cant show us proof they did. Now they are asking for there 1300.00 dollars they gave us in the beginning back. My question is are we legally obligated to give them the money back. Or did they breech the contract.
