I live in Ohio, this is my situation, I am dire need of help, to make a long story short, my wife has pretty much made our home a "Squalor", she has several dogs, and this place looks like something from the tv show "hoarders", I cant take it any longer, I need to get out of here if nothing else for my mental and physical help, I have tried cleaning up, but soon as i clean it up, it is right back the way it was the next day. We are currently going through a bankruptcy, we will not be keeping this home, I NEED OUT OF HERE VERY SOON, it is really affecting my health. My question is this: I need to know if i should try to hang on through this bankruptcy, or can I leave ASAP? Will the Bankruptcy affect the Divorce? There isnt much to split up, she has a vehicle, and I have a vehicle, I have my stuff and she has hers, we are not keeping the house and we dont have children, can someone help me please?

You can leave any time that you like. Its the financial considerations that you need to take into consideration.

I sure hope that you don't intend to leave the house like that for the foreclosing lender, and that at minimum you folks will clean up the mess you created there! You have at least a moral obligation to leave the house as nice as when you moved in. Nobody wants or deserves to be stuck with a house full of dog feces and hoarder junk.

I have been workin very hard to clean this up, I mentally cant take it anymore, I work night and day, soon as i get something cleaned up, she trashes it up, if I have to, I WILL pay for it, at this point, I have exhausted all my efforts, nothing works as far as motivating her, I have ALWAYS cleaned the house, I would have days off from work, and spend the whole time cleaning up after her, it has take a HUGE mental toll on me, and I am getting to where I cant take it any longer. I am asking for advice, I am at the end of my rope.

Has she had a physical and/or mental health evaluation recently?

She has not had an evaluation recently, but she is being treated for depression, she is on fairly strong medicines, it keeps her moods in check somewhat, she has been hospitalized for suicidal ideations, and that is another thing that worries about this whole situation, I am not a mean person and it is worrying me to death that if I leave her she may try to commit suicide. I have been to counseling myself, and my counselor knows the whole situation, and she agrees wtih me, that I need to get out of this situation, and just to maybe call 911 if I think seh may be suicidal. I have tried every form of motivation I can think of just to get her to help me, and the only thing that even remotely works is me getting mad and throwing a HUGE FIT, and I really dont like doing that, my family has a history of anger problems and I really have to watch myself, because I have seen what an extrememly angry person can do.

You probably need to ask the court for sole possession, as she is creating "waste" to the property, which is against the terms of the mortgage. Deliberate waste is not necessarilly dischargable in BK.
