I am a Guardian Ad Litem volunteer and need a complicated question answered for one of my cases.

A Korean couple marry in Korea. The legally immigrate to the U.S. and have one child. They decide to get divorced and go to the Korean embassy to finalize. As part of the settlement the embassy awarded child support and no alimony.

Now the mother is an American citizen. Question: Can the mother now file in US courts for alimony? She is destitute.

As a GAL, you should have plenty of resources to get this answer. But, let me ask you this...why does this concern you? As a GAL, your duties are to the child(ren).

Mom needs to find a way to support herself.

The US does not have jurisdiction over a Korean divorce settlement; if Mom wants to reopen the decree she'll have to do that.
