Security Deposit Refund

Renting in Oregon. Sent a certified letter giving new address and requesting security deposit refund and itemized list of deductions. Been over a month. called today and they said we had a balance due and that they sent information out about a month ago. We have not received anything from them, and they were unable to give me the amount due or the address they sent it to. I called and left messages today but no one has gotten back to me. What should i do next?

Sue the bad guy in small claims court.

We moved out 2/4/2012 and sent the certified letter 2/6/2012. They said over the phone they sent something on 2/10/2012. I do not have the certified letter receipt any more. Is this going to be a problem? Should I send another letter requesting the information again, perhaps giving them a week to respond? Want to have all the bases covered before I pursue legal action. We have a signed walkthru document from our property manager that states there is no damage beyond normal wear and tear. I understand that this is not the final word on the deposit refund, but to go from that to us owing them money seems pretty ridiculous to me. Is just a copy of the certified letter sent good enough? If they had not received it or denied it it would have been returned to me already, right?

Why would you bother sending something certified if you weren't going to retain the proof? At this point, it seems that you didn't notify the former LL of your new address.

My advice remains unchanged.

I lost it somehow, I know its stupid. Thats why i was wondering if i should resend it so i have evidence for court. And what address would they have sent the information to if they didnt have my new address. Im pretty sure this will end up in small claims court, but i want to have all the evidence i need.

The would have sent it to the last known address. Unfortunately (for you,) you recently moved away from that address.

Good news. Found my certified mail receipt. Mailed it on 2/7. The notice was left 2/8, but the USPS track and confirm says the item was delivered 2/16. Again, the LL said they mailed something to us on 2/10. Where does that leave us?
