Deed Correction solution needed

What is the name of your state (only U.S. law)? New York

I need a deed correction on a property I own, On the Deed, the corporation name is missing a word, apparently the previous sellers attorney gave the title company the deed with the word missing. I understand that a deed correction is needed, but the previous owner died and her 2 heirs refuse to sign the deed correction. There must be another solution , how can a previous owner prevent me the owner since 2006,from selling the property , thanks in advance, Bill

Me the op didn't know there was an issue until the new title search was done to sell the property and found out that there was a proplem.

How about this solution, The corporation only owns this one parcel and if I do a corporation name change to have it match the deed ,than everything will match when a new title search is done.

Sorry, you knew what was on the deed. That you didn't know the error was a problem is not going to toll the statute of limitations.

You are not going to be able to trick this problem out. Deeds are important legal documents. Even if you could fool people into accepting the deed through the corporate name change, the other parties who's signatures you now want will know. All they have to do is look at the dates and they would have proof you committed fraud. Would you like to go to jail over this?

so, you did not read the deed when it was delivered to you? How do you know the deed you received transferred full title to the property?

How about this:

you go to court and prove to the court that the named grantee was actually who you claim it is and there is a mistake that needs to be corrected?

Get an attorney. There are so many problems here once things got all fouled up that it is not easy to fix. Heck, there may be a hearing to even know if you have standing to sue for anything. It is going to cost money. If your attorney saw the deed, you should review your engagement letter to see what the scope of his representation was. Failing to catch the error may be malpractice. If he is still your attorney, the statute may have been tolled.

Why was the deed sent to the lawyer? What was the relationship with the lawyer? Was he the counsel for the corporation (and speaking of which, the corporation is the owner, not you. You may own the corporation, or all shares but the corporation is still a separate and unique entity/person)?

The only solution I can see is heading to court with all the pertinent documents to prove that the property was sold to the corporation (the properly named corporation) and not some other corporation which has a similar name. The court can make the correction but it will only after you prove the named corporation is actually your corporation with a misstated name.
