What is the name of your state (only U.S. law)? New Jersey
I want to file for divorce but I don't know where my husband is. He left on Feb. 21,2012 Our house is under foreclosure he left me with all the big bills. He doesn't want to pay for child/spousal support so he is hiding out of state probably with his sister or friend. There is some equity in the house also he has bench warrant in NJ and PA
how do I get divorce?
how do i transfer house to my name?
how can I get child support and spousal support?
He made 80k last year.
my son is 13yrs old
I am homemaker always took care of my son.
the reason he didn't pay mortgage and other bills because he gambles a lot, recently he was arrested for possession of drug. He has two DWI in NJ and two in PA.
We were married for 25 yrs.
His gambling and drinking problems started 3-4 years ago.

A few things -

How long were you married? How old is the child(ren)? How much did you earn last year?

You cannot have a house transferred to your name. You can apply for a mortgage in your own name (if you can afford to bring the note current) but your husband would need to sign off on the "sale." I'm presuming the home was bought during the marriage and your name is listed on the Deed?

Does he have any family that you can contact to obtain his location to have him served? Have you checked Facebook, checked to see if any mail is being forwarded, etc?

I strongly encourage you to call around and see if you can get a couple of free consults with attorneys.

Has there been any financial activity by him anywhere? If he has a drinking and drug problem, have you checked various police departments and hospitals to see if he was in an ACCIDENT or had an overdose situation? Has his employer heard from him? Why do you believe he voluntarilly dissappeared, rather than something unexpected happening??

And, honestly, if he has addiction issues, you NEED to seriously plan your finances based on him being unreliable. This started 3-4 years ago? Are you now working?

He was in the hospital for over doze on Feb 21. Then he went to his sister house after that I don't have any contact. His employer had to let him go in the mid Jan. 2012 and told him to go to rehab.
can I get divorce if he doesn't come to court? how many months does it take?

Good question, or his doctor? An overdose (and continued drug use) has the potential of creating permanent impairments.

You said he "left" 2/21, not that he OD'd 2/21 and was hospitalized and let go at work.

Have you started working on getting financially prepared if he is unable to support you or himself?

Okay then your statement that he "left" on Feb 21 is not totally truthful. In fact he overdosed and was hospitalized on Feb 21.

I don't really understand your need for a quickie divorce? However, that being said - it does not matter if he goes to court but he does have to be served. If you have no address in order to serve him, then service will need to be completed by way of publication. This = longer period of time to get a divorce.

You obviously have internet access. So someone is paying that bill at least, true? And electricity as well. I again encourage you to call some attorneys and also recommend that you google NJ divorce laws so that you can gain a better perspective of what to expect.

Realistically, if the house is in foreclosure and you don't have a decent paying job, then you cannot expect to be able to keep the house or the equity in the house.

If your husband has a serious problem with gambling and substance abuse then you can also expect that you probably won't be seeing any money from him either.

Unfortunately that is reality. You are going to have to support yourself and your child. Its time to get a job or get into school to train for a job.
