House awarded to me but mortgage is in ex’s name …….need help in NH

I am a working mother of three who lives in NH and received my final divorce decree back in OCT 2011 awarding me the House. The mortgage is in my ex’s name only through a company in FL and he has refused three court orders to sign over the paper work so I may assume or refinance the home in my name. He also has blocked me from talking to the mortgage company since it is not in my name. I am paying the mortgage and have been current through this entire process. I have spent 10’s of thousands in legal fees, cashing in my retirement and savings. I am out of money and directions to turn. Any advice or help would be greatly appreciated.

You can apply for a refinance without him (if you are divorced, and you can likely get a court order for the lender to provide a payoff for the date you wish to close). In whose name is TITLE?

Do you qualify for a refinance (apart from the court order)? What is your income? What is the down payment? What is the equity? What is the value of the house?

title/deed is in both my ex's name and my name. My house is definitely not upside down, the value is around 180k, will need to finance 150k to pay him his equity. currently, the market is very strained here. I am not sure whether I qualify or not, I was given verbal qualification from a loan officer who has dealt with me many times in the past. I may need a cosigner, but I have also done enough research that I can be considered a first time buyer.

If the value is 180k, why would you need to refinance 150k to pay him off? Is the current equity (based on a current appraisal) 60k?

the current mortgage is for 130k and his equity per the court order is just under 20k, therefore, 150 takes care of his equity and his current mortgage gets paid off
