What is the name of your state (only U.S. My name is Mary, My husband and I do not get along, We a 2 girls 16and 11
I filled out separation paper online, I am not sure if they are correct .Really not sure of what to do. I have been married for 16yr, when I first had children, my husband told me not to work to raise my kids at home. I have not worked 15yrs out of the 16 yr we been married .We have not gotten along for about 10yrs, we tried over and over ,but it’s not working out, We are miscible together and can’t stand being around each other .So we decided we needed to separate on good terms. When he looked at the paper work, he had problems with child support both girls want to go to college and I am asking to support then until 21, thinks are different these days and I am not working on the books. I work 3 hours a day doing childcare. I do not make much. I think I deserve alimony. He makes about 2,800.00 a month so we will need to sell the house. I need help. Thank you, mary Reguero

You should google your state's child support calculator to find out about how much CS will be awarded. No one here can help with that since you didn't answer the first question.

State matters.
AND, you need to get a job. In most states he will NOT be ordered to support ADULTS. You are NOT entitled to alimony. And with that amount, quite frankly you are NOT going to get alimony if he is paying child support.

Time for you to follow the law and work legally -- even at Walmart.

I encourage you to remove your last name from your post.

You need to indicate which state you reside. Some states will order child support until secondary education is completed. However, not all of them. further, if neither you nor your husband has a college education, it is possible that Dad will not be responsible to support them through college or contribute to their college costs. It truly depends upon your state laws.

As for alimony, there have been recent changes to the alimony laws in a few states. Thus, as noted by Ohiogal, the state you reside matters. No one can assist without that information. Realistically, though, your children are not exactly toddlers and don't need you to be at home with them. They both spend the majority of their day in school. Your 16yo can be in charge of your 11yo until you get in from work.

Understand that divorce brings about many changes. Even if Dad is ordered to pay you alimony $2,800 is not enough to support 2 households so the family needs to be prepared to cut back and pinch pennies wherever possible, as soon as possible.

The sale of the house is certainly required considering the limited finances of the family. Hopefully, you are able to sell it for more than what you owe.

You also did not indicate if there are any other assets - Pension plan, 401K, vehicles, etc.

What sort of Joint debt obligations do you both have that you and he also need to be paying off?

Is that figure gross or net? Is he also paying health insurance? $2800/mo is a very modest income. If you and he accrued a lot of debt sustaining your current lifestyle for just one household, it will be totally unsustainable on that income with two households.

You need to get working, supporting yourself and seriously saving for college, because his income won't begin to cover two households, let alone two AND two college educations. Not to mention what you need to make sure you are stashing away into IRAs and 401ks on your own for eventual retirement age.

Honestly, if you''ve been thinking eventual divorce for a long time, you should have gotten back to work a long time ago. $2800/mo will NOT realistically support two households unless you grow all your own food and don't need to buy gas or something.
