I live in Oregon, but my custody orders were originally filed and still remain in California. I moved to North Carolina a few years ago, but I moved to Oregon last year along with my kids. The father of my children, the one who originally filed in California, moved to Oregon about a year and a half ago. Since I moved to North Carolina and the home state for our children was California, he obtained Full physical custody with joint legal custody. But over time, he sent them to me because he was doing his thing, and they stayed with me in NC until we moved to OR. So here I am, been here for a little over 6 months and suddenly he has his mom 'take' them to school out of the blue. She never returned them to my house, which is where they primarily stay since we've moved to OR. And he wont answer my phone calls nor text messages and when I sent him an email, he just responded with, I have been advised to keep the children in my care until further notice...So I am trying to figure out how I can change the jurisdiction of the custody case from CA to OR, and what exact forms I need to do. I don't have money for an attorney at all, and I have called the police, but they said there's nothing they can do because even if our court order was registered in Oregon, he would have the custody. Please help me. Thanks. Oh and the original case was filed in riverside county.

Is there a concern for the safety/well-being of the children while in the court-ordered custody of their father?

He is usually at work during the week, so he's basically having his mother watch the kids. There is no physical harm that I can think of, except our son, 5 years old, has said that his dad spanks him from time to time. My ex's mother is not the best person to be raising them, since both of her daughter got pregnant at age 13 to men who were in their 20s while they were both in her care, and her youngest son got a girl pregnant when he was 15 and dropped out of school at the same time and was getting high all the time, again under her care. That's one of the main concerns I have, and that he might be taking them over his sister's house, which is lice infested and is being investigated by CPS (not by my doing).

You will have to submit this to the Riverside Superior Court.

However you may want to instead write a motion not only requesting the transfer of venue to your county in Oregon, but a change in custody based on the fact that the children resided with you for at least the last 6 months at the request of your ex. With this brief (a written motion) you attach your evidence such as emails.

The motion can basically state the same things that the form does, but is written in a special format. You can find formatted pleading paper on your MS Word blank document list.

Oh thanks so much! I'm going to look into the link and try to figure out where to go from there.
