If a guy was 17 years of age and a girl was 14 years of age in Texas when a baby was conceived is the boy able to be prosecuted in the following situation. They both live very close to the Arkansas border and the only time they had sexual contact was when they were across that borderline? Would that be a viable defense since the Statutory Rape laws in Arkansas would make that not a crime at their ages? There is no proof that they did or did not have sex at another time, but would it not be the prosecutions responsibility to provide the proof?
Also, the male is 3 years and 1 month older than the female so would that fall under the 3 year law in Texas making it legal there as well?
