Why are you so resistant to getting it all in writing? Is it so you can stick it to your x? Specific court orders protect everyone.
b/c its only protecting him. he knows i will push for him not to have visits so by getting a court order with specific start dates (last day of school beginning at 7pm) he can trap me.

im asking, if i sign his proposal, will the judge sign it without going to court? he doesnt have a change of circumstance to ask for a modification

Are you really this dumb? It protects you if he shows up on YOUR weekend or YOUR holiday and shouldn't be there. It's black and white? Geez ... go to the attorney who you are paying and let him deal with you. And I'm the kind one.

I have 3 other children with birthdays during the summer. he wants to plan it specifically where MY son wont attend those. thats why he is doing this b/c i have already said i wont agree to it. the court order he wants to change is only to protect him so he has specific start dates and can trap me. im asking if i sign will we have to go to court? can the judge just sign it without hearing any sides? there is no change in circumstances for him to change the original order so why/how can a judge sign it without that change?

A judge would side with dad because it is very obvious that you will do anything to thwart dad's rights to parent your mutual child. And why not do like everyone else does? Celebrate the birthday when everyone is present? If you want your child to always be with you, you have two choices: marry the dude and stay married to him, or get artificially seminated so there is no legal father. Forgot another option: single parent adoption. You have to remember that you picked this guy to be the dad.
