Can father file for a fault divorce based on adultery if he committed adultery on multiple occasions before? Will my mother be left with nothing? Reason why is because my father is trying to stiff my mother. He cheated on my mother over 10 times in there 25 year marriage and she did once. She did during the latter part of the relationship when they were already talking separation. I heard SC has an infidelity law but in this case both have committed its just while talks of separation my mother did it last. My mother and father came to agreement years ago when he said he will work and she can take care of the 4 kids. My mother has been a housewife for 25 years. All the kids are grown. Can he file for a fault divorce based on infidelity? Also my mother has not been able to gain job skills during that time and currently has a medical condition where its hard for her to work. Can he really stiff my mother into giving her nothing?

Yes he can file for fault divorce based on adultery if your mother committed adultery and your father did not live with her as man and wife after finding out she cheated.

Sounds like she forgave him for his adultery but he may not have forgiven your mother.

She will be entitled to half the marital assets and half the marital debt. She MIGHT get spousal support but maybe not. You by the way have no legal right to be involved in this divorce.

Mother still lives with father

Mother still lives with father and has for about 6 months. Both have not sough out counseling.
