What is the name of your state (only U.S. law)? MI

I hate to ask for clarification of what should be simple arithmetic, but I have to.

Our custody arrangement says we split summer vacations 50/50.

Summer vacation begins on June 14. The last full day of vacation is September 3.

First, 50/50 split is indicated by number of overnights, correct?

Secondly, how many overnights are in this summer schedule?

You have three holidays involved. Take out that time. Then count the rest.

I did the math as you said. Fourth of July is two overnights. Labor Day is three.

Dad and I don't find the number of summer overnights to be the same number. That's why I was asking for someone else's take on how many overnights.

Are you really so concerned about one parent or the other getting one day more than the other?

We are lucky she didn't want to count down the minutes or seconds and only the overnights. Why one more overnight matters I don't know. I say give it to dad if dad is the NCP. Or mom should get it if she is the NCP. Most people just alternate weeks when they split the summer if close enough.

Yep.

A year ago Dad hit me with a trumped up custody petition.

I met with him and asked him to work something out so we wouldn't have to involve lawyers and the court. He flat out refused, and lost his case. I spent $1500 on a lawyer.

Then he continued fighting for more days. I paid a few hundred more in lawyer fees. He lost.

The day that decision was handed down, he claimed to have been unemployed for quite some time and petitioned for a support reduction.

Then he accused me of being controlling, and in the next breath asked me to put together a summer schedule. I spent a good deal of time doing so and he responded by saying it was petty, but he is entitled to one more day.

So yes, I'm concerned. And since I paid so damn much for those legal documents (which I'd always been really flexible with in the past), we'll follow them to a T.

So.... Who is this all about? You, Dad or.... the kids? Seriously - both you and Dad need to get over yourselves. *I* would give the NCP the extra overnight. Big flippin' deal.

I count 81 overnights, if 6/14 is actually a full day off school (the day FOLLOWING the last day of school). If not, then 80.

That's without taking out holidays.

How is OP going to help kiddo with math, ever, I wonder, if she can't add, herself.

Honestly, I just *had* to read this thread because the title creeped me out so much since I received a letter from one of the inmates where I work that had that same exact phrase in it...today. The guy was so overly-dramatic, as well, calling himself a hostage. Dramatic...hmmm wonder if he and OP are related...

My son doesn't seem to need my help in his Accelerated Geometry class. Go figure.

Also, I did come up with 81 days. My ex is the one who didn't. Must be him who needs the math help?

And you....you shouldn't assume you know anything. You are not that smart.

81 days is the total overnights. You have a total of 7 overnights during this time that goes to holiday time, with dad getting 4, cause he gets Father's day and 4th of July, you get 3 of these overnights cause you get Labor Day.

So thats 81-7=74, split that in 2. Dad gets a total of 37 + 4 = 41. Mom gets 37 + 3 = 40.

So dad gets one more overnight then mom this year.

Seriously your not really going to fight over 1 night? What is your time split during school? If I remember correctly, you have more during school. If I remember correctly your in the same court that I am very familiar with in Mi. Search function is not working properly for me to look it up. If you have more time during the school year and are in the court system I am thinking you are, I would not screw with this at all, give dad the extra day. That court is not happy at all with CP's who fight over 1 lousy overnight when they have the majority of the time during the school year.

It's very petty, makes no difference what you have spent in past court actions, be the bigger person, both you and your child will benefit in the end. Or you can behave petty just like dad(that you say is the problem and the pain). If you do that, your going to spend more money, you won't benefit nor will your child from it.
