My boyfriend is separated and filing for divorce. His wife is a philippino citizen, he has american citizenship. She's claiming to charge him with having an affair (Which is illegal in the Philippines, and she has tons of evidence.) unless he agrees to pay $1000 dollars in child support each month, till their son turns 18, and if he doesn't she will not agree on the divorce. My questions are, can he truly get in trouble for that? Even though he is a US citizen and hasnt lived in the Philippines for 6 years. The next is what can we do about her? Her demands are outrageous especially when Washington state child support is only 250 . She will be graduating and becoming a dentist soon, so she really does not need that much money, especially when we cant afford to give her that much. Please help.

Sorry, this forum is for US law only. We cannot advise you as to the legal process, etc., in another country.

This concerns Phillipino law and NOT US law therefore no one here can help you. But apparently he is committing adultery and she may be able to get a divorce there with sanctions allowable by their laws.
ETA: If he is filing in the US then US law would apply. And in NC YOU could be sued for sleeping with a married man.

Didn't the Op mention Washington State?
Where do each of the parents currently reside?
Who currently has the guardianship?
Did either party file for legal separation ( again contingent on the state of residency)

NC is irrelevant.

I didn't see the state until rereading just now. True. NC is irrelevant. Wasn't sure what state this was though until just now. Apparently Washington. But the Phillipines have jurisdiction over the child.

The Phillipines does not have jurisdiction over your boyfriend (therefore he cannot get in trouble for that while living in the US) and your boyfriend doesn't need her consent to get a divorce. However, the Phillipines won't recognize the divorce unless she can prove that he got it against her will, therefore it may or may not be in her best interest to cooperate, depending on what she ultimately wants.

Child support in WA is NOT an automatic 250.00. It is calculated based on the respective parent's incomes and the timeshare with the child etc.

Actually they very well MAY have jurisdiction over him if he married his wife in the Phillippines OR lived with her in the phillipines or meet any of the other criteria. Please quit -- because this is incorrect. However if the wife never lived in the US the United States does not have jurisdiction over her or the children.
