Hello. Can the wife or husband be liable for any funds withdrawn from joint accounts prior to the date of separation that has been established by the court?

for ex; if the husband withdrew $50,000 before the DOS, does he have to pay half of it back to the wife?

Possibly yes. Where did the 50k go? For what was it used? From what account was it withdrawn?

Just a general question. I always figured that whatever money was taken out of a joint account prior to a DOS being established, it was fair game.

So... did you already spend it all?
No my sister is going through a divorce and I attended to support her. I think it was a hearing, not a trial? But there were other cases in the same court room and one of the cases involved the date of separation which lasted quite a while. I always thought these things would be more private, since imo could be a bit embarrassing for others to hear your personal situation.

All cases are tried before the public. Unless the court has held a specific hearing regarding sealing them.
