Yeah, sorry about that - I'm not a lawyer. I understand it was .. adjudicated in CA. But there were no legal ramifications in NJ (so far). I don't know what the word for that is.

When you were prosecuted in NJ someone should have run a criminal history check on you which would have shown the CA conviction.

If that wasn't done, or if it did not show up for some reason, then you are probably fine. I cannot imagine this just popping up on it's own and there is absolutely no reason for anyone in the court system in NJ to go poking around for a long closed case.

I wouldn't waste time worrying about this now. Concentrate on staying on track with your drinking.

I should mention that I did just attempt to purchase a firearm after being approved for a license and handgun permit. The NJSP/NICS denied me after a 3 day delay. I have nothing else on my record besides these DUIs, so that's probably a whole other matter. But I AM definitely worried that in the process of running me through the NICS somebody somewhere found the CA incident, put 2 and 2 together and this CA thing is going to come back and bite me.

Well, my permit was not denied.. I was given a permit and a license, but when I went to go use them to purchase a gun, the NICS check done at the counter denied me. I am thinking the DUIs could have had something to do with this, because I really don't have anything else on my record that I'm aware of...

The real worry is that the CA stuff could pop up and some computer somewhere will talk to another computer, and bam, I'm screwed...

You would be screwed only because you deserve to be screwed.

Not for nothing, but you really don't know the circumstances of the DUIs and whether or not they were deserved. Frankly, I wasn't driving for the last two. That doesn't matter to the courts. I'm screwed because I have really f'ing bad luck. But thanks for your input.

Seriously? A DUI is a DUI. Some states require you to actually be driving, others require you simply to have full access and control of the vehicle while intoxicated. If you were intoxicated and in one of those two situations, and you got caught, then the DUIs were TOTALLY deserved. And, I might add, if you didn't think they were, then you (or your attorney) could and SHOULD have challenged their validity in court. However, since you were convicted, then they had to be valid (or you just were too far gone to care about fighting them).

Bad luck has nothing to do with it. You are screwed because you got caught breaking the law. That, sir, was a choice you made, not just the luck of the draw.

I did challenge the validity in court. The judges did not believe me or my witnesses. The first one I was driving, I will admit to that. The last two - passenger seat. I suppose there are reasons for this law, but I can't see what they are. Either way, injustice does exist in this world. I learned my lesson - never drink again, regardless if I'm driving or not.

That doesn't make too much sense.

Someone should be able to tell you why the purchase was denied. Maybe NJSP can. You should be able to ask someone you had contact with during the application process or they should be able to get you a contact somewhere.
