What is the name of your state (only U.S. law)? OH- I had a van lease in my name that my wife of 13 years drove for almost 2 years. Now that we are divorcing is the responsibility all mine for the lease? If we got it while together, would we both be responsible for it? I know the lease company views it as my obligation, I am speaking from a legal perspective.

What does the court order state? Whoever drives the van after the divorce (whoever is awarded the van in the divorce actually) would most likely be held responsible by divorce court. The divorce decree should state it.

I have a vehicle provided by my company and do not need it.

we had purchased a truck and paid it off. the truck was in my wifes name to build her credit. she wants to keep that (no payment) and force me to take the van, and the payment even though i dont need it either. i am scheduled to get 1/2 of the equity for the truck. Divorce is not final yet.

I'd guess the court would give you the van as it is in your name and your credit and you can do with it what you will. How much equity do you believe is in the truck?

We have come to an agreement on the truck value at about $15K. it was always my truck and I get why she is doing this but still agitates me. The van was always hers. its strictly money. i just didnt know if we were jointly responsible for the debt and thus would we have to split the cost of turning the vehicle in since neither want it.

Things to consider -- your company car counts as income for child support and spousal support purposes. What type of truck is paid for?

From a lender's perspective, the party that was granted the financing is considered the one fully responsible to make those payments. Any agreements a borrower makes with someone else is not binding on the lender's contractual recourse.

Yep, my imputed income is considered in all that. the truck is a 2003 F350 diesel.

Just got an offer today for me to take 60% debt, 2K a month CS and 1K a month SS. Over the last 3 years i have avg about $120K annually and her about $30K although she is college educated and was only working part time. She works as an MRI tech at about $28/hour
I have played the nice guy for 13 months now, continued paying for everything at the house from 100% of all debt and her monthly expenses.


From a lender's perspective, the party that was granted the financing is considered the one fully responsible to make those payments. Any agreements a borrower makes with someone else is not binding on the lender's contractual recourse.

How is she going to transport four people in the Ford F350 diesel? Is it an extended cab? She should be imputed for a full time income. Ask for that. Also the SS would be calculated BEFORE child support so that the income is properly adjusted. Do you have any temporary orders in place? Where are the children living? What vehicle has she been driving during the last 13 months?

The truck is a crew cab and can easily for 5 or 6. We are going for her to be calculated at full income as she is able to work as all kids are in school. She has purposely not found work to keep the difference between us. for the last 13 months she has driven the van that I paid for. I was being nice is keeping everything as "normal" as I could for the kids. the kids remain in the house with her. we have finalized our shared parenting plan and it is being submitted to the court today actually. I get the kids every Tuesday from 5-8. and every Thursday from 5:00 overnight to Friday. Then every other weekend.

What's wrong with debt= 50/50, guideline CS and no SS? She's just as responsible for marital debt as you are and has a sufficient earning income potential.

Being a nice guy won't get you anywhere but paying more marital debt and alimony.
