1/3 length of marriage equals 4.3 years.she asked for 1/3length of marriage or somewhere between 4 and 5 years,
Permanent alimony for a 13 year marriage is insane. "Getting off pretty easy", whatever that is supposed to imply, would be NO alimony at all!Of course listen to your attorney, but generally any time your alimony payments are time limited rather than permanent, you're getting off pretty easy. And alimony payments are tax deductible to you.
That's the problem with alimony proponets. They believe some alimony should expected in ALL cases and dream up factors such as length of marriage and income disparity, which has absolutely nothing to do with whether a spouse NEEDS support or not.I think SOME alimony should be expected given the income disparity and the length of the marriage. But, OP should listen to his attorney as far as whether accepting the offer is a good idea. No one else knows ALL the details of the case.
The other factors are totally ridiculous and put in place to be purely punitive. I'm not saying OP will not be ordered to pay alimony, he probably will be, but, he should understand how the stupid laws got there.Because NEED is not the only factor that is looked at in determining whether SS will be ordered
No such thing. Ohio does not have numeric guidelines for Spousal Support. What do the state guidelines say you should be paying in CS?
Be sure to insist that the SS be modifiable in case you lose your job or become ineligible for the bonus. Courts become real nasty when the realities of life interfere with the judges orders.her lawyer has no desire to goto court. She asked for $2K CS and $1K SS for 4 years.
I countered with $1800 for CS, $600 for SS and 25%f my bonus. The SS and bonus would be for 3 years. i am eligible for a $17K bonus annually.
I did tell my lawyer that my ex will only receive the bonus if I do so that is covered. why would it end if she becomes romantic with someone? Do you mean if she had someone move in?Be sure to insist that the SS be modifiable in case you lose your job or become ineligible for the bonus. Courts become real nasty when the realities of life interfere with the judges orders.
Also suggest you get clear and concise language that the alimony ends upon remarriage or if she becomes romantically involved with anyone.
