Can a judge dismiss a suspended sentence if you show proof of compliance two months past the deadline? Is it mandatory that I go back and serve time?

I live in MA but was convicted of DUI in CO in 2009. Completed all probation requirements with the exception of education and therapy and probation was revoked. I went back and turned myself in and was given 8 more months to complete it. I will complete the classes but due to financial issues it is going to be 2 months after the deadline.

Seriously you don't believe that court orders apply to you. Can the court? They COULD. But don't count on it. Count on serving some time due to the fact that you have ignored this for three years! You were convicted in 2009. You were on probation. During probation or sometime in the last 18 months (minimum if the conviction was December 2009) you could have done this and yet, why haven't you? Financial issues? You should have gotten another job or worked longer hours. Something. Expect the court to not take pity on you.

If you go to court in front of the same judge w/out a completion letter, you may have an issue.
