What is the name of your state (only U.S. law)? WA
if my husband filed for divorce here in Wa before I could, I have no income because I am a mother of two childen one 3 and one 19mo staying at home. Can I still have a chance to keep the home and children or will he have all rights and leave me with none

In your last thread you wanted to leave the state and run with the children. Now because he has filed you want to kick him out of the house and keep the kids?

If you don't have a job you can't afford the house so you won't be able to keep it. Get a job ASAP because you cannot count on spousal or child support to pay your living expenses. If you get a job, you will be more likely to be awarded the house but that is not guaranteed. Can you refinance the mortgage and buy your husband out of his share of the marital home? Or is he the ONLY one on the mortgage and deed? Since he filed for divorce, you will NOT be able to remove the children from WA without court permission. He doesn't get automatic rights because he filed first but he does protect his rights to his children and his home and prevent you from running with the kids.

I am trying to get a job. Been trying for a long time to get a a job and get a divorce. It's not that easy when you are abused because you're not allowed to leave the house. Or when you have one car and he insists he needs it.
The house is in both names but have not been here a yr yet. not sure I can refinance.
Found out I can only get TANF IF he moves out. But he tells me I can't have a lawyer becaus he filed first. He automatically wins full custody because he filed and has a lawyer and has the job. So he gets everything and I get his bills. Thats what I'm being told.
I wasn't planning on relying on child support or dshs. I want a job. I am trying to get a career.
AND BTW !!! My mom started this post under my username trying to find help for me.

Do not attempt an office job that requires proper grammar and spelling. You won't succeed. Also, username sharing is not appropriate.

Poster: If you have no income, or eventually get just TANF, you are unlikely to be able to refinance. It is unlikely you can cover the mortgages, taxes, insurance and maintenance expenses on just TANF and child support.

He won't get "everything" but IS likely to retain whatever he brought to the marriage. just as you should be able to retain whatever you brought to the marriage.

Whomever financed your cars and house is not a party to the divorce the secured asset should best be retained by whomever is certain to have the aBILTY TO PAY AS AGREED IN THE FINANCING TERMS.
