What is the name of your state (only U.S. law)? Michigan


Hello all.. I have a friend who lives with her husband and their young child (4-5 years old) and he is abusive both physically and mentally. I was wondering if there is any way for her to get some kind of separation from this turd. I think she told me that Michigan passed a law saying you cannot separate legally while still divorced. How is this so? Like, "sorry its the law so keep getting beat" Is there any way to get a restraining order or something of that sort? She would just get a divorce but she works full time and he doesn't so she cannot afford it. Don't forget there is the child involved too. Any advice will be appreciated. Thanks.

why are you posting for your friend?

As her friend I would urge her to go to a women's shelter with the child. They can help.

Not all states have an "official" legal separation status but that doesn't mean she has to keep living with him until they get divorced. She needs to contact a shelter or therapist that can help her form a safe exit plan.

My take on this is OP's friend is divorced from her abusive husband. For some strange reason she's still living with him and would like to legally separate from him but thinks she can't because they're not actually married, they're divorced.

She is a friend that lives near me but I talk to her on the comp. She does not know anything about forums and such so I told her I would ask. The "still divorced" was a typo. And she has no family to go to with her daughter and all. I mean a way to make HIM leave, legally. But Thanks for the replies and I will pass on the advice. Feel free to reply more if anyone knows anymore about how this works. Thanks again.

She reports his batterings of her to the police, he is arrested and jailed.

Your friend is not stuck because of abuse. She has MANY options but she needs to be strong enough to make the first move. A women's shelter is a good place for her to explore her options.

In this situation she must talk to a legal person who can tell you that what should she do? Definitely there will be another reason to get divorced with his friend.
