What is the name of your state (only U.S. law)? Illinois

I will try to be brief and please forgive the English.

I had a few drinks at a friends house. Not too many and felt perfectly coherent and Ok to drive. On my way home I got hit by someone coming out of the alley (hit and run) I was shaken up and very up sad but have been advised by a police officer friend to go home and make a report in the morning if Im ok and the car is drivable. I wasn't thinking and just figured I should do that. On my way being so freaked out and trying to make sure I keep the tires straight as I got hit on the front tire side I missed my turn and got lost. Now I don't know where I am and dealing with the car Im pulled over by police. (pulled over for not having back lights and driving suspicious. Back lights went out do to the damage of the front electrical damage)

I pulled over and at this point Im totally freaking out and cry and try to explain what happens. I was asked to step out and do all the tests for DUI. I have always heard from people....If you have been drinking do not take the breathalyser test so I refused to take it. I was very up sad and my legs hands were shaking...needless to say I was having a hard time doing things I was asked to do. I was taken in and arrested for DUI. While I was at the station I was able to calm down and answer all the follow up questions. Im sure my shaky behavior earlier and the fact that I was lost and so confused made the officers assume that I was seriously drunk and probably hit something.

I did get a report for my accident in the morning and the way my car was hit it would be quite impossible for me to hit it myself in such a way.

I don't know what to do now and how serious this is do to the evidence. What should I do next? Does anybody know if this looks like something I can fight. I have a completely clean record, never been in trouble in my life. I read some of the DUI things on line and it looks so scary.

You are going to need an attorney. Refusing to take the breathalyzer was a big mistake.

This is serious and you will need a lawyer ASAP.

Your refusal to take the breathalyzer was a foolish mistake - you live in an implied consent state, this means you agreed to a breathalyzer on LEO demand. Refuse it, and you are looking at a 1 year license suspension for your first offense.

You had been drinking and had been in an accident which you didn't report - of course the police are going to think that your 'shakiness' is due to that. Your lawyer will need to assist you with the details of that.

You are looking at a hefty lawyer's fee and/or other charges and penalties associated with whatever else you may or may not have done. Hire an attorney today.

I think in IL its an automatic revocation for refusal. Its hardly "scary" .. you lose your license for a period of time and pay a large fine.
