Comon Law Couple With A House (PLEASE HELP)

I own a house with my ex-boyfriend. We have since broken up. Both our names are on the mortgage. I put down 10 thousand dollars of my own for the down payment.

He wants to keep the house himself and give me my down payment back. He wants to get his own mortgage for whats owing on the house.

The problem I see is, the house is worth more then what we paid. We did many upgrades. I think I'm entitled to more.

I'm trying to keep the peace but have a felling something is not right. He keeps tell me that there will be a 50/50 split.

I'm questioning the 50/50 split cause how do you know the value of the house?

A friend said this and I want to know if this sounds right or not...
"He wants to get a mortage for whats owing on the house. After he gets that he will give you back some money (Maybe). A few months down the line he will put the house up for sale and make some money and you wont get anything". Does this sound like something that could happen?

At this point I have not contacted a lawyer and I'm letting him handle everything.

I really need some direction to figure out the right solution to my problem.

Any advice will help.

Then why on earth are you posting on a LEGAL website??

I suggest you see a local attorney (solicitor) in your area. Pay for an hour of his/her time, ask your questions.

Or I suggest you post your US state.

Or I suggest you find a hobby, like embroidery.

When was this so called common law marriage created?
And additionally when was the house purchaced and who is on the deed?

is he willing to give you the ten grand now? will he refinance to buy you out of your half of the deed? what is your ultimate goal here? is it half of the houses appraisal amount, or do you just want to take what you can get and be done with it.

My concern is him screwing me over on this house.

He could get a mortage in his name for whats owing and not give me a dime.

This is my future so I'm not taking this as a joke. I really want to know the best way to deal with something like this and if hiring a lawyer is the best way to protect myself.

You aren't going to be understood if you refuse to use proper terminology. And taking on a term that doesn't apply to you doesn't confer legal rights you never had.

I can't imagine being able to give you help over the internet. I'd suggest an attorney.
