I have a domain name , I am not going to name it here but I need assistance in regards to that.
Domain theXYZ.COM was registered by us in 2004 and there is another gentleman register that same domain name in 2000 XYZ.COM , and he filed for the trademark in 2001 but it got Abandonment - No use statement filed and now the trademark is dead but we file for a trademark last year and got it registered with USPTO office this year, for the same name, can we go after this person who actually owns XYZ.COM and tell him to surrender that domain name to us as we own rights to that name as he just have that name for sale on his website & some customer of ours emailed us stating if we are out of business because they forgot to add (THE)xyz.com and they accidentally typed in XYZ.COM which shows domain for sale.
I just need some sincere advice from some expert who specialized in this field and guide us to the right direction what to do as far as obtaining that domain name.
