evedentiary hearing

What is the name of your state (only U.S. law)? Ca

I have a feeling my ex as a last ditch effort to try and overcome a 730 psyc evaluation that states I get the deciding vote if parties fail to agree.

is going to go for a evidentiary hearing, I know nothing about this and was hoping someone could shed a little light on one.


Nothing changed at all, the status quo is working and the child is flourishing with my choice of school. Mother isnt even accusing me of any wrong doing. [thats valid]


in the mothers filed motion, she only states she can do a better job then me and wants to be able to pick the school, near her. problem is I work weekends.


I also have the medication report with the mediator stating the child should stay with father as well as a child specialist that states child should stay with father.



brough this up before "here" without the evidentiary hearing, but the thread is buried and id like to start a new one.

Well no evidentiary hearing just yet.

Sounds like the real judge will keep the child in school here and will just tweak the mediation schedule a bit

Hes putting the decision for deciding vote for father back on the table, and stated Res Judicata didnt apply.


Child will be in school here for 3 weeks when we are seen again to finalize custody.


You can make all the fun of me you want. this is stressful and I just wish it was over.


Judge did mimic last years parenting schedule to a T, and made note that he didnt want to mess with whats working.



the only mistake I made was not taking teh 730 evaluation to the mediator, but im not sure how much impact that would have had being 3 years old

judge didnt seem to think so.

he's taking this as a fresh case

he's treating he 730 eval as if it was worthless, the mothers past history if im guessing right is why I have her in school now and I dont think he is planning on changing that, so I will/should retain the 70/30 split with mom.


on a good note the judge gave us both a positive comment as mom was trying to take a vacation day away from me.

he stated wouldnt it be nice if all parents loved their child as much that they would be in here in front of a judge fighting for minutes of custody.
