When a transcript is ordered, is a copy offered to the opposing party or available to the opposing party at a discounted rate?
Or, does this vary by state or county?

I am attempting to ask if an opposing party would be allerted to the existance of a transcript, or if they would have to contact the court reporter themselves to discover this information.

Contact your court reporter and ASK that person. YOU'LL get the absolute yes or no from them, and WE don't "have to" do any research FOR you. :cool:

In my not-TX opinion, there's no reason to offer a transcript to Customer #1 for full price and then to Customer #2 for less-than full price.

It really depends on the context of the situation. For example, in an appeal, the party appealing generally is required to obtain a transcript because it would be almost impossible to appeal a case without one. If the appealing party uses that transcript for their appeal, they generally have to provide at least parts of it to the opposing party...and possibly all of it. Why? Because its evidence that they are using for the appeal.

I have an attorney. They are on vacation. I have ordered numerous transcripts in the past. My recollection is unclear though I believe I recall court reporters informing me that a copy of an ordered transcript would be offered or available to the opposing party at a discounted rate- this due to the fact that it is a certified copy, not another transcription.


I do not wish to get too off point here by including too much information. The amended question hits the nail on the head and a respectful thank you to those in the know.
I will however add more information if it pleases the esq. I do not wish to contact the court reporter to allert her to my desire to not inform the opposition that a default judgement has been made. Court reporters talk to judges. I do not wish to give them any reason to talk about me.
Is this back story sufficient at this time?

Thank you for your response.
It is not an appeal. I am not concerned about giving a copy if the transcript is used in a future case.
I would use the transcript of the ruling to have a substitute attorney pen the order made by the judge if the vacationing attorney does not get it done quickly enough.

Thanks for the reply. I understand why you would say it feels smarmy. That's why I'm here and not ignorantly asking the court reporter if they will be informing the opposition, and cancelling the transcript order if they will.

Would you say it is good strategy to inform the opposition that a default judgement has been rendered and remind them to appeal within 30 days?
I am protecting a child and allowing the judge's ruling to be affected. Not really smarmy after all.

Why don't you ask the reporter BEFORE placing the order?
Why do you need the transcript in the first place?

I have to retract my prior response. You should be talking to your attorney about this matter. Vacations don't last forever.
