Docking Pay for Hours Worked

I had car trouble and called in to work an hour before my start time, I'm an hourly paid employee. My employer said he'll dock 4 hours pay from last week's hours worked as a penalty, is it legal to take away pay from hours already worked?

I would say probably not.

Tell him you would rather have the 4 hours pay you are legally owed and be fired for not being on time instead.

No. He cannot dock you for time worked. He does not have to pay you for the time you were not there due to the car trouble, regardless of when you called in, but you still must be paid for all the time actually worked.

Yes of course.

However, if you read OHR's post you'll see that the firing would be for being four hours late for work - and that would be perfectly legal.
