Out of the blue, I get this document from my ex.

Short history: he abused my daughter many years back and I have sole legal/physical. There is no visitation. He tried to reestablish that a year ago, but his lawyer withdrew in March, so it went nowhere. Her motion to withdraw was the last, until this. I accessed the court site and found this:

Ordered that Defendant shall file a Request for Order of Default against Plaintiff. Failure to comply within 15 days of the entry of this Order may result in dismissal without prejudice.

this was filed on the 21st. I received this document today. Does anyone have any idea what the default is about and what i'm to comply with?

Seriously, OP - if YOU don't know, how can we be expected to know what he's filed for a default ruling on?

Sorry. It made no sense to me, however there have been lots of filings I haven't understood that I was told were just standard procedure. I just wondered if it made sense to anyone else.

Ok, am I correct to assume that you are the defendent and he is the plaintiff? If so, I think that what this is saying is that you either needed to file a default motion against the plaintiff within 15 days, or the court would dismiss the case for lack of action.

If its the other way around, then it would appear that you did not respond to something that you should have, and the court is offering him a chance to file a default motion against you, before they dismiss the case for lack of action.

In any case, the 15 days have already passed, unless its 15 business days. In any case, follow the advice of the others and call the court clerk in the morning and ask for an explanation.

No, he's the defendant. He filed it on Sept. 21, so I'm well within the 15 days. My lawyer emailed two docs to complete and send to the court to answer this. Then, she'll do a motion to vacate.
