By all means, if that's what you feel comfortable with, than go with it. Now you can spend what money you can get together on a lawyer with specific expertise in family court. goodluck.
Thank you sir! So far, that is what I feel comfortable with...but...if things take a turn in some way or the other, then I can still hire a private attorney correct? Like I wrote above, it looks like my soon-to-be-ex knew what i was doing and was playing her own little game on me. That should get the stalking charge dropped at least.

Damn...we have both been so childish and stupid. And through all of this, our kids are the biggest victims. I need to understand that and focus on them. I know they will probably need therapy and I know I will have to build their trust in me up from scratch. I am willing to put in the work. It is incredibly how strong they've been that they haven't already lashed out yet. The only one to have lashed out has been my eldest (16 year old) and it was against his mother because of her drug abuse. I worry about him and will do what I can to be better for him. My younger son is a cancer survivor and very sensitive. I know it will take the longest to re-build my relationship with him. My nine year old daughter is amazing and strong. I can't wait to see the three of them. I love them very much. I pray that through all of this, they will come out stronger and better people than their parents have shown to be.

$23,691 is the household income standard for CO. If your income is 75% above that, you do not qualify as indigent. As I said before, something is very fishy in Denmark. I suspect OP claimed he had no income, while he was on suspension.

I just sent an interesting email, linking these posts and copying in relevant portions. Can anyone guess what email address I sent it to???

Here is the other portion of the email I sent;

https://forum.freeadvice.com/sentencing-parole-pardons-plea-bargains-29/plea-bargaining-584219.html

To whom it may concern,

I thought your office would be interested in this link, regarding someone you are providing a free public defender to. The user name is nmstorm32 and here are a few of his posts, for your reference, in case he deletes his thread info. As you can see from his posts, he does not deny his employment or ability to hire professional council. By his own admission he was put on paid leave in a GS-11 position, which pays about 50k to 60k per year. The last post was made today, so his meeting with his PD today will also aid in your identification of him. As a taxpayer in another state, I am outraged that he appears to be getting away with criminal use of your government services.

You can send whatever you want, I'm not lying to you or to them. I didn't qualify as indigent based on being below the minimum income guidelines for my household. I qualified on expenses versus income. (which i do believe I already posted) I posted in my application that I make over $63,000 per year and I qualified. It's that simple. I have no reason to lie to anybody. In Colorado you need 150 points to qualify for a public defender. I got 125 points for having less than $750 in assets and being charged with a class four felony. I got 50 points because my monthly expenses exceed my income by over $100. As I mentioned before, I have over $1,000 per month taken from my check due to debts being collected for my younger sons cancer treatment. Add that to all my other bills and I am easily running a negative even though I make a decent amount of money. So not only did I qualify but I had 25 points to spare!!! Income guidelines aren't the only way to qualify.

I never publicly admitted that I could afford an attorney. In fact, quite the opposite. If I do hire an attorney it will only be if one of my distant aunts lends me the money and I don't know if she will. If you don't believe me, here is a link to the site that includes a .pdf with public defender qualifications.

I don't even understand why you would feel compelled to go so far. All you had to do was ask me and I would have broken it down for you. We are all free to do what we want though.

PS...I have no reason to delete this thread.

You admitted earlier in this thread that you lied (yeah, I'll use the more harsh term now) about your monthly expenses.

I did? Where? I don't remember that, can you link to it because I can't find it. If I did, it was not intentional or not what I meant. I need to read it to know for sure.

In fact, after talking to my PD this morning, we realized that i had under-estimated my expenses. I wasn't including taxes or student loans in the formula which added quite a bit more and in two weeks I'll also be including alimony.

I would love to know how you have less than $750 in assets. Do you not own clothes and a car? A computer? Household goods? I donate more than $750 in assets from garage sale leftovers.

If you read state guidelines as soon as you check income eligibility you are not eligible.
11% to 75% above
guidelines (Not eligible if income is more than 75% above guidelines.)

Easy, we don't own a home. Due to a bad deal, I'm over $5,000 upside down on my only car and my wife has everything else. Really, the only thing I own are my clothes and unlike my soon to be ex, I rarely buy clothes. I spend almost all of my money on my ex and children. In fact, I also forgot to mention that I have three pay-day loans that I can include in my lack of assets and my income-versus debts. I am not lying...I came from a very, very poor family and i've only been a GS-11 for a little under a year. I had $4,000 in savings but my wife cleaned it out the day she left and actually left me with over $1,400 in bounced bills. I have a laptop that I bought this weekend on Craigslist for $80 (I was so happy to find such a good deal).

Our household goods are used furniture that don't amount to much. In fact, I used an online spreadsheet to calculate my assets and included it with my application just to back up my application. I didn't want anybody to think I was hiding anything. The only assets that I have are my small government retirement which I was told by the PD and several other people doesn't count.

Ask anything you want, just like everything else, I'm being as honest as possible...even if it is not what I should be doing.

PS...I came to this site for HELP. I had no idea that this is what I'd get instead.

Did you ummm miss this part?

If the defendant’s income (or that of a juvenile defendant’s parents/guardians) is at or below the
income eligibility guidelines and he or she has no assets, as determined on form JDF208, the
Public Defender may automatically elect to represent the defendant, and will submit the form
JDF208 to the court to demonstrate eligibility.
• If the defendant’s income (or that of a juvenile defendant’s parents/guardians) is more than 75
percent above the income eligibility guidelines, the Public Defender will note that the defendant
is ineligible for court-appointed counsel, and will submit the form JDF208 to the court to
demonstrate ineligibility.

It's no use - OP has it all figured out.

Good luck.
What do I have figured out??? I came to this site for HELP!!! Obviously, I don't have it all figured out or I wouldn't be here. You just called me a liar and I asked you to link to where I lied. If I did lie, I have no problem in admitting it. I have no reason or want to lie at this time. I'm past that stage hopefully for good.

I am surprised at all of this.

You have NO IDEA what I've been through...no idea...but I don't argue with your right to judge me any way you want.

I don't see how I'm whining or being a crybaby. I came on this board asking for suggestions and expressing remorse for my actions and regret at my past inactions.

And "from the sounds of things" you don't know if I'm guilty or not!! I didn't lie in court like I'm being accused of, I tried everything I could to stop the situation but she wouldn't listen. She knew that it was me and intentionally went to court just so that she could say that she did it because of me. I have witnesses to testify to this now. I never involved the police, she did, and did so on purpose because she knew that it would come back on me. I never tried to frame my wife's lovers wife to the police...never. I attempted to hurt my wife the way she hurt me and I had kept it bottled entirely between the two of us. Yes, it was childish, vindictive, stupid...dead wrong. But it was kept between the two of us! The other parties did not even know about it until my soon to be ex-wife got the police involved after the fact and she got them involved on purpose because she found out what I was doing to her (which again was limited to just the two of us before that). I've found all this out very recently (as in this morning) that she knew what I was doing for months. She hurt me because I hurt her and I hurt her because she hurt me and vice versa. She was just (much) smarter about it than me. The whole situation is dumb, and unnecessary. I should have known better and should have realized that it was obvious that she knew it was me (like I said, I just found out that she knew).

I've been as respectful as I can be on this board and I don't think your disrespect was justified or warranted. I'm not going to tell you what to do but if you aren't happy with anything I've written you can freely choose not to respond. I respectfully ask that you not insult me.
Dude you don't even realize to what you admitted. My disrespect? What about YOUR disrespect to your wife's lover's wife by framing her? What about that? Oh she doesn't matter because your male ego couldn't handle it. I understand exactly.
