Husband cheated, has child...now child support payment

My husband and I have 4 children together. He had an affair 2 years ago, and the woman got pregnant...so he has 5 children. We have all been involved in child support cases that finally settled today...finally! And while I am pleased at the outcome, there is one thing that I questioned but never got a satisfying answer...

In the child support calculation for his payment to the other woman, the court would not allow our youngest son to be included since he was born AFTER the date on which she filed the paternity suit. So in the calculation for his payment to her, it shows that he has a commitment to only 3 of our 4 children, thus making his payment to her higher. It just doesn't seem right to me.

Anyway, like I said, it's finally settled. Just wondering if anyone on here has any insight. Thanks!

His 4th child comes before his 5th child in priority. Obviously he knew about #4 before he went about creating #5. It was calculated properly. His child with you is not more important just because it's with his wife instead of his mistress.

You are correct. I was just barely pregnant with (our) #4 when all of this hit the fan. Thank you for your explanation; it was never explained as "priority", but rather just as he wasn't born before the time of the filing. I understand that our children together are not more important, but I did not understand why he could not be included.

You still haven't learned that YOU were NOT legally involved in the child support case. YOU were not a party.

Well, since we are divorced, and he has to pay me child support...then I AM a party. I said "child support caseS" in my original post.

I didn't include all of the details because I was only asking about the priority thing. You shouldn't make assumptions; you know what they say when you assume...

Well since you are divorced, he is NOT your husband so maybe you should learn to communicate properly.But if you want to continue misleading people due to your inability to communicate the correct circumstances that is on you.

Since she was apparently happily in a married relationship 8 months ago, she likely has not come to the realization she is a failure.

I was wondering why the court took the 3 older children into consideration when CS was being decided, because, to my knowledge, Alabama does not take into consideration children living in the home when CS is calculated. :cool:

It is amazing to me that in 8 months she went from happily married to duking it out in a divorce. I wonder if the divorce is just on paper in order to get as much money as possible but she will still be with her hubby. In other words, to lower the support to the mistress.

Wow...once again, you people love to gang up on others when they are down. I came here just to get clarity on the priority issue, not to have to explain any more of the situation or defend myself. We are divorced...done. My children are now from a broken home, which is a situation I was trying so hard to avoid; and it didn't work out.

I got the information I needed; now you can go pick on someone else.
