What is the name of your state (only U.S. law)? ARIZONA.

I will try not to make this long. Seperated from husband months ago. We have a 3 1/2 year old. He has been telling me he is filing for divorce but it was taking to long so I filed. I filed for joint Custody and even gave him the truck that is financed with me as the cosigner. The house was bought by my before we were married. The things in the house were accumulated together but the things that were purchased by him were done with illegal money. There is not proof of what he bought or when. I have been being harrased by him. Have pages upon pages of text messages printed out of him doing so and my response or lack of when he does. He has had my house raided in the past for selling marijuana, they found nothing when they came but did find prescription drugs without him having a script. He currently has not been charged. We both have had a criminal history, mine minimal and I have actually gone through and completed the processses of having my previous guilt set aside. His is for dangerous drugs and aggravated assualt and he did 12 years in prison. I am scared that his threats of filing for sole custody and everything else could actually take me to court for all of this. I want things to be civil but doesn't look like a possiblity. Please give me any advice or ask me any question thats you can think of that would help!

I would also suggest seeking the services of an attorney. Knowing that you have an expert in your corner will help you calm down.

As for his/your past history... a lot will depend on how far in the past it is. Were his drug and assault "issues" what led to the 12 years in prison? If so, they may be moot. If they are recent? Then they may hold more weight.

I might also suggest that you don't attempt to use his criminal history against him, as it will not look good on you either. At the very least you have been complicit.
