Neighbor Moving Trash Can...

O-k. So this is probably one of the most pointless problems I've encountered in some time, and to be honest I actually feel bad wasting anyone's time with this but I looked on google for about an hour and found nothing specifically useful.

Here is my issue, I have lived at the residence I am at for 4 years with the same two neighbors to my east and west for the duration. The first week I placed my garbage can to the left of my mailbox (measured 6 feet west in front of my house from the line coming from the neighbors fence line to the road.) and I was told from Waste Management that it needed to be placed to the right of my mailbox (measured roughly 1 foot west of the line extending from the neighbors fence line to the road) next to my neighbors can or they wouldn't pick it up. They offered no explanation just left a note on top of that moved trash can that said "Place receptacle here or it won't receive pick up". So I started placing it where they left it. For four full years. Today my neighbor knocks on my door according to her four separate times until she woke up me and has moved my trash can to in my driveway and tells me it needs to be off her property.

If you took a chalk line out from her fence to the road you might have just barely grazed an inch of the side of my trashcan with it. More importantly there is a sidewalk that is set back from the road and runs across the front of both of our properties and the trashcans both mine and hers are being placed on a blacktop pad to the right of my mailbox. It is my understanding that the area between the sidewalk and the road doesn't belong to the homeowner anyway so my question is since she threatened to call the police because I said "I put the can where the trash people said to put it" does she have any actual legal issue? Again for everyone the can is NOT in front of her yard, on her grass, or anywhere near her driveway/car.

I actually have no advice. I am just amazed that WM is so picky about pick up spots.

Personally I would just place the trash an inch more toward you. If WM doesn't pick up call the city and complain.
 
Just so I understand you ... your trashcan encroached onto your neighbor's property by one inch, you defended the encroachment by explaining that you were told to put the trashcan there, and your neighbor threatened to call the police. Does that sum it up?

If I were you, I'd keep the peace by moving the trashcan one inch so that it is entirely on your property. She sounds like a nut job.

Each relocation of the truck takes time and involves wear and tear. The extra few feet, while insignificant for one week, can amount to transporting the trash can several miles, when multiple residences are factored in. If they use an auto loader, the distance requires repositioning the truck completely to align it. If the can is not on her property at all, she has no gripe.

thank you lol I really thought people were going to call me all kinds of stuff. I play WoW so I'm really not used to people being logical about stuff, but yeah that's about it. To be honest I'm not even sure it's that one inch. I looked down the fence line from my side of the fence and it looked clear but she was swearing to God that it was in her yard. More importantly like I said it's between the side-walk and the road. Not even on her grass. It's on a blacktop/asphalt 3x5 pad that extends from the street to the sidewalk that is directly to the right of my mailbox, half on my property and half on hers. I place my garbage can on the half of the pad that is on my side, next to her garbage can which she places on the half that is on her side. I actually just assumed the pad was specifically there for collection but yeah WM literally told me to put it there. My westmost neighbor said that had a similar problem but that they eventually found out what the issue was was that the WM guys like to set the can down and start driving forward as soon as it the boom arm clears the can and if they did this with my can they would have clipped my mailbox. As stupid as that is I'm sure that couple seconds of moving forward while raising the boom arm over a hundred or more houses makes a difference. Either way I just wanted to see if she could actually call the police or if the county easement laws would allow me to put it where it is.

Tell her you will be happy to oblige her, once she provides you with a recent professional property survey and marked boundaries.

ROFL. I work at Home Depot, did general construction for a time and I know what she'd have to go through for that bs. I think I'll let it slide this time but the next time she decided to threaten to waste the authorities time with something so infantile I just might say that. That my friend is pure gold.

Thank you everyone for the advice. I'll make a small effort to make sure it isn't on her property but that thing is going on the pad where it belongs and not directly behind my car. If she starts anything over it again I'm a patient enough person to take it the whole nine yards. I'm assuming there is some kind of larger problem and she's just being passive aggressive and it's probably best we sort that out.

Ok so it's not just the World of Warcraft forums that are full of the rejects of society haha awesome to know. Seriously though the responses I've gotten were surprising and I appreciate everyone's help. I decided to make it a non-issue and I asked her if she would have an issue with the trash can being placed there only on the mornings of collection and only until they collect it after which I would promptly move it back to my fenceline and she agreed so god only knows what was up with her yesterday. Bad day I guess? Thanks again everyone. The next time I need help I'll remember this place.
