Still Waiting For the Decision

My Microwavegate fine was due on 11/9 but I was hoping the Judge would vacate the decision. Nope, not vacated, I paid it.

I have sent 2 letters to a Judge and The Bar so far regarding this case but i need the Judgment letter to really make my point.

I got a letter from Justice Court today and I ripped it open. It's a summons for Jury duty for the local court that I've come to know so well. It's the first one for a local court in 20 plus years. Oh, I do hope it's a Code Enforcement trial......

Does anyone else know of this fight?
Yes, the Judge who heard the Civil Case "was not pleased" when she found out that the Defendant perjured herself in front of the Chief Justice of the State of NY. The Defendant said some incredibly stupid things, never dreaming I would get my hands on her testimony. She admitted at our Civil Case trial that she lied and made false charges against me to Code Enforcement. I don't know if this has anything to do with the lengthy delay of her verdict, but the Judge should have vacated the Judgement against me and did not.

The Town Attorney, who was implicated in the Defendant's testimony, was called into the courtroom by the Judge to hear me read the Smoking Gun transcript and do cross exam. This transcript was admitted into evidence.

I sent a complaint "package", as it was much more than just a letter, to the Grievance committe about the Defendant's lawyer because the transcript showed she let/encouraged her client to lie to the Chief Justice in order to procure funding for herself. The testimony also states the lawyer told the Defendant to go to Code Enforcement and make these charges against me with no proof. I was then arraigned, prosecuted and fined based on hearsay.

I sent a package to the Administrative Judge who heard the Defendant's testimony at The Legal Services hearing asking her to take action against the Defendant and her Attorney as well as asking for legal help for myself to stop the Town from prosecuting people based on hearsay.


I am waiting for the Judgement before writing the Chief Justice. I am also waiting to contact the ACLU again. Too bad I don't have an extra $10K for an Attorney as I claearly have a case against the Town.

So. I'm guessing I won't get to be a Juror. My decision against the Town is already made without even hearing the case.

And all this because 1 person did not want to pay her rent.

I didn't appear in front of Lippman.

I stated earlier in the thread that person who started this mess testified before Lippman and a panel of judges at a Civil Legal Services Hearing in NY, the point of which was to get funding for firms that provide free legal services for the underpriviledged/poor. Her attorney had her do this lauding her merits in order to receive funding for herself. I found out about it and got a copy of the transcript which is a public document online. She testified specifically as to our case. Unfortunately. for her, her testimony was a work of fiction in which she made 27 false statements with her Attorney in attendance. She bragged about getting me charged by Code Enforcement. The Attorney knew she was lying; evidence had been presented in Landlord/Tenant court 2 months prior to this testimony as to what actually occurred.

At our Civil trial, I pulled out this testimony at the end and cross-examined her on it. I had already again presented my case with the same evidence. At that point she fell apart like a cheap suit. First she was evasive, and you know how much Judges like that, then she started changng her answers, at which point the Judge asked her if she was trying to recant the testimony she gave Lippman. Finally she just broke down and said she was lying. The Civil Judge was none too pleased with her.

I had called Lippman's office when I found the transcript. They said people like her make a mockery of the hearings and that they would investigate her for perjury and her Lawyer for putting her up to it. So, I just sent him a letter with a copy of the marked up transcript, along with documentaion showing she was lying.

Interesting.

Might also want to consider following up on the whole perjury thing with a local prosecutor (or state AG), as that is a criminal act.

I'll leave that up to Lippman and the Admistrative Judge, Prudenti who both have a letter from me now. I don't think anyone ever gets prosecuted for perjury but it certainly creates a problem for her Attorney who put her up to it to get funding. I have already filed a grievance with The Bar.

I'm still waiting for the Civil judgement.
