No final divorce

Nothing went to the court house yet. Me and the ex get along pretty well for our daughter sake so I've left it up to him. Plus he still covers me under his health insurance. But he is obviously dragging his feet.

We had an agreement drawn up by the lawyer with the amount stated and that I would leave his retirement alone. I will have to check about a time limit. I don't recall any and to be honest would have never thought it would take this long. Heck, in 4 years he could have saved that much.

Yes, as far as he said there is enough. He got the house assessed and that is how we came up with the 10,000. I'm starting to think something isn't right too.

I realize that him giving me 10,000 won't officially divorce us. And I don't think he is stalling for emotional reasons. He is in a relationship with someone else. Perhaps he can not refinance and isn't telling me. If he can't, what can I do to get the money? Sigh.

That agreement is not a court order. He is NOT in violation of a court order then. You could have saved something in four years as well to file. This is NOT on him. YOU played a role as well. Why are YOU dragging your feet? Time to put on your big girl panties and actually take responsibility for your own life.

Time to grow up and be an adult and handle things. File for divorce and request an equitable division of the debts and assets. Put in the original of the agreement you both signed and ask the court to make that the order of the court at the time of your divorce and to grant you a divorce. But quit whining about what he hasn't done when you have done NOTHING.

I can easily understand a judge not putting the "agreement" in to place as an order if on of the parties disagrees. It's not like it's something they signed a few weeks ago. The document is 4 years old and nothing has been done (on either side) to move forward with it. It's entirely possible that the house no longer has the equity needed to fund the agreement.
