My rights against Ex picking up personal belongings.

What is the name of your state (only U.S. law)? New York

My Ex is adament in ruining my life and took me to family court claiming she had personal belongings still in my house even though we seperated 8 months ago and she took all her belongings with her at that time.

I think her goal is to take my mothers jewelry which does not belong to her.

The judge is allowing her to pick up her personal belongings with police escort. My questions are:

1. How can I prevent her from taking my personal stuff?
2. Can she search all my house? There are multiple people living here, what about their privacy?
3. Can I video tape the entire thing in my house?

Remove your deeply important personal property to another location

Ask the cops.

Discuss with the cops.

I dont see how that will protect you, but if you fee better...

Thanks for the repsonses. I dont have a lawyer due to financial constraints thats why I am seeking this forums help. I also spoke with the police and they told me she can only take something that is not disputed by me.

I would like to confirm this and ask for more advice/feedback. Thanks.

That is probably right. I have used a civil standby before, and only non disputed items were removed.

Also ask, when they get there, that she list the items that belong to her, that she expects to find.

REMOVE jewelry, paperwork, and whatever else she might be able to slip in her pocket, its best if you don't chase her around the house, and just remove whatever it is you want to protect and let her look around this one last time. The police are definately not going to make her show EVERYTHING she is removing, so play it safe and remove things to another location for the moment.

Also ask that the cops limit the time.

I once had a roommate forcibly removed from my home. He arranged with the police a time which he could come back for his personal belongings. I was allowed to inspect every item he took from the house before he left to ensure he took nothing that was mine.

That was great for you but it doesn't always work that way.

Why didn't the court order her to do that in the first place?? OP could then have the items ready at the front door. Seems she wants in the house just to nose around.
