I am in TN currently, but the computer was used without authorization (and the FB set to auto-login) in GA.
I left town, and left my computer behind. Without my permission, my roommate got on my computer, moved/deleted files, and then left her Facebook set to auto-login. I got moved back to TN, booted up my computer, and hit the FB bookmark on my toolbar. I was logged into my ex-roommate's FB. I read the messages she exchanged with her boyfriend, my other roommate, and found some things. The boyfriend spoke of 'destroying my stuff,' and some of my things were broken when I came to move out. The boyfriend also spoke of people coming to pick up items that belonged to me... Conspiracy to Commit Theft, am I not correct? The girl talks about breaking open a vial that at one time contained Dilaudid (I had been given it in the ER, but had rinsed it out, so I could keep it as a collectible), and trying to get high from the moisture left inside. I know selling fake drugs is as illegal as selling real ones... would she be guilty of stealing a Controlled Substance... at the very least I know that it is destruction of property. I also trusted the guy to transport some of my prescription medication to my former boss/best friend as he was making sure I didn't take more than I was prescribed (it is a Sch. II Controlled Substance); and he admits to breaking the capsules open and pinching a little of the medication out of each. Can I take screen shots of these portions of the conversation, and use them as evidence in a case? Or would my admission that I had read the messages get me in legal trouble. Are there any other ways to get the conversation used as evidence without saying I read it (i.e.- having someone say they saw a portion over the guy's shoulder at work)?
