My fiance was disabled in a work accident over a year ago and his mother was given custodianship of him (so we are told) or at least had medical and financial POA. Suffice it to say she owns him. She has since become more and more mentally unstable (i.e. she is threatening suicide and verbally putting him down and complaining that his condition makes her life extremely difficult). My fiance isn't completely disabled and he has been getting better since the accident. He no longers feels safe or comfortable in her care. Is there a way to switch guardianship to another party? Would it have to be a relative or could I possible get it even though we are not yet married and I currently live out of state? He is unable to speak to his doctors or his worker's comp lawyer without her present, per her request. This is part of the reason why I am asking on his behalf.
