Actually, not quite up to date Pro however, a quick Google of "VAWA expiration date" reveals it was renewed about 4 days ago by the House and Senate and heading past Obamas desk.

(Now granted, Wiki is rarely a source I use here - but in this case? It's accurate.)

So I assume you're now in agreement? With that and also that I-751 is NOT appropriate unless the spouse in question actually has been granted her conditional residency?

Just so we're all on the same page.

can you ask if i divorce right now if he will pay me everymonth

It's I-864, and yes he would have signed one in order for you to adjust your status (which you have done successfully since you have the conditional residency).

So, yes, he is contractually obliged to make sure that you don't end up on welfare. You can use the document itself to negotiate a settlement, or you can sue him separately (in Federal court).

With all of that said - you NEED an attorney to help you.

i will take her to the Bar Association this week and so she can get her own lawyer. I know this is not my business. I just know (being married to a foreign national myself) I know how daunting the "system"can be.

So I will assist her with this last part and get her to the right people.
