My mom has Alzheimer's and lives in a nursing home, my sister has complete control over and is abusing mom's finances, no one has Power of Attorney or Deputyship right now.
Very long story short, my sister is an extremely aggressive and abusive alcoholic, she and her husband were mentally abusing mom when she was still in her own home, they changed all the locks so I could not see my mother, after a lot of communication with Social Services they did remove mom from home and placed her in a nursing home, they also hired an attorney to apply for Deputyship over her finances, the social worker who dealt with my sister wrote a letter to be included with the paperwork to the courts which stated how aggressive my sister was to social workers, when asked for a copy of mom's bank statement my sister gave her something off online with no bank account number or name, my sister told the social worker she was on a joint acct with mom but refused to show proof, also that the management at the nursing home had expressed their concern as my sister visited mom while under the influence of alcohol, the social services acknowledged the drinking problem was a concern, that when the social services suggested she go for Deputyship so she could legally sell mom's house, my sister told them no, you do it.
The fact is, my sister and her husband want to be able to use mom's money, rent her house our and take the money without being questioned.
At the last minute, someone higher up in social services asked the attorney to stop proceedings for Deputyship stating that the letter from the social worker should never have been sent to to them, the reason is because it is not "factual based" and they now do not have a problem with my sister being appointed Deputy, I am in complete shock!!!!! Of course it is factual based.
I think my sister has threatened some kind of law suit.
My question is....when I oppose my sisters application for Deputy, is it legal to include the social workers letter to the court? I want to make sure it's okay and my sister can't get everything thrown out because of it.
I have searched all over the internet but cannot find an answer.
My mother removed my sister as Executor of her will years ago as she did not trust her, my mom's attorney is now Executor. I do not live in the same country, my mom is in the UK but we have always been close.
I'm just trying to do the right thing and protect my mom.
I want to include the social workers letter to the court but need to find out if I can.
