This is seriously backwards. Why haven't YOU filed???
Reason being is because my custody case has been going in my favor thus far. My attorney just told me that I will be served with divorce papers this week. Maybe then I can file for exclusive possesion of my home.

I'm sorry but this makes NO sense. Unless your attorney has specifically told you NOT to be the one to file, then you are just whining to us. You can't complain about ANYTHING if you haven't even FILED FOR DIVORCE YET!

You do not have to be divorced in NY to file for child custody. And yes I was advised NOT to be the first to file.

That makes absolutely no sense whatsoever. However, if that is your intention then you have to live with the consequences.

People often have the mistaken idea that filing first somehow puts them in the "wrong". That's just not so. Not in NY, not elsewhere.

Are your wife's guests paying their way? Is the mutt destroying marital property? A wasteful dissipation of marital assets accusation might be in order when you finally do divorce.

BTW, OP... You're mistaken in your thread title - it is you WIFE's parents. She's not your ex until you actually divorce. She's not your stbx until one of you actually files.
