What is the name of your state (only U.S. law)? CO
I signed up with a new auto insurance company in Febraury via telephone. I asked for full coverage as my car is still being leased. The quote they gave me was acceptable for full coverage and I paid down payment and signed up with them. I found out this month, that the entire time my coverage has been only liability and when I changed to full coverage they are advising me of an outrageous monthly premium that I would have never agreed to, I would have shopped around. I am assuring them that I requested full coverage from the start and due to their error I want my down payment refunded so that I can use it to go elsewhere as I have already recieved a quote for full coverage with another company that is far less than what they want to charge. They are basically treating me like I am crazy and made the mistake. When I ask for a copy of the intial sign up call, they say they do have it but I would need a subpoena to get a copy of it.
- How do I go about getting a subpoena for them to provide me a copy of the phonecall? Can I do it without a court judgement first as I of course would like to hear the call and decide plan of action.
- My leanholder of the car is how I found out about liability only insurance. They have added a insurance charge of $1400 to my car loan and raised my monthly payments based off the new balnace. Can I get the insurance company to give me this back as well for the timeframe it should have been fully covered assuming the call is exactly how I remember it?
- Any other advice would be awesome. thank you.
