I most likely will be filing for divorce soon & need advice. I have been married for 16 yrs and we have 3 children. I have been a stay at home mom the majority of the time and have only worked a couple of days a week when I did work. I am the primary caregiver as my children and my children have never had to stay with a babysitter.
I had an affair recently that my husband is aware of. He is wanting to work things out & has no plans on filing. If I file I know that the affair will come into play and I will be honest and say that if I do divorce I most likely will eventually date the man I was having the affair with. My question is: How much bearing will the affair partner's past have on child custody? He has a felony conviction, but was never in prison. He served 6 months in the county jail and is now on probation/parole for the remainder of his sentence. It was a nonviolent/non drug related crime. I am worried that this could make me lose custody of my children.
