Can I get my non-fundable deposit back?

In order to be placed on a waiting list for a puppy I signed a contract with a local breeder and gave her a $200.00 non refundable deposit. I told her that I wanted a puppy in late Spring or early Summer, at the LATEST.

She had 4 dogs expecting litters and led me to believe there were only "a few" people on her waiting list and those would be "cleared out" after the first litter was born. I learned later on that there were actually 13 people ahead of me.

Now it is 4 litters later and I still have no puppy from her. I found another breeder and have a puppy coming home at the end of June. However I'd like to use my $200 to apply towards the new puppy and the former breeder is refusing to return my deposit even though she was unable to supply me with a puppy during the time frame I wanted.

What can I do?

Really? It is still late Spring and we haven't gotten to early Summer. Summer starts late June. So July is actually early summer. So she still has time to supply you with a puppy. What did your written contract state regarding the deposit? What did it state regarding a puppy and when you would receive a puppy?

Unfortunately no. This is certainly a live and learn experience. Knowing what I do now I would have done a lot of things differently. The contract refers to applying the deposit to future litters for up to one year. However with the anticipation of four litters due I never thought it would come to that.

The WRITTEN contract controls. Your deposit will be applied to future litters for up to one year. So congrats on your puppy come fall. And why do you NEED a puppy late spring/early summer? Why is it a NEED and not a want?

Pick a breed, look up your state's RESCUE organization. That's another excellent way to find available pets that need a home.

HHmmm, maybe it was an issue with no money in the OP's account the check was drawn on and the demand for payment upon presentation to the bank was non-fundable

heck, given this information, don't get upset if there is no dog late spring early summer. It would appear the contract is in effect for up to one year. No dog after that, go get your money.
