My elderly mom was injured at a 'gym' where she was in physical therapy for shoulder replacement. She stepped on a treadmill that was left on and was thrown into a wall, resulting in a multiple shoulder surgeries and ongoing issues.
Suit was filed and a 'value' has been placed on her case (by court) that is not even enough to pay attorney fees and the insurance subrogation. She has accepted this 'offer', but has been told that if the opposing attorney rejects it, a trial will be required and she will be required to pay court imposed fees of $5,000...and if 'she' loses in court, pay upwards of $40,000.
Does this sound right?
